Trespass and Nuisance

When a person enters on another person’s land without lawful permission that is a trespass. The landowner is able to sue for an injunction and damages. Boundary disputes can be an action in trespass. The court is able to make the usual orders and can grant compensation even though the trespass has not caused actual damage.

A hurt or annoyance to another person in his enjoyment of land is a nuisance. Escape of water or fire from one house to another is a nuisance, as is a noxious smell from a neighbour’s premises or loud music played at unreasonable hours.
